In a significant ruling on Tuesday, the Supreme Court held that a divorced Muslim woman has the legal right to reclaim the dowry and other gifts she gave to her husband at the time of marriage. The court said the Muslim Women (Protection of Rights on Divorce) Act, 1986 was enacted to ensure the dignity and financial security of divorced women, and items given at marriage directly relate to that protection.

The judgment came in response to a petition filed by Roshan Ara Begum, who sought the return of ₹7 lakh and 30 grams of gold that her father had given at the time of her nikah. These items were also recorded in the nikahnama. The Calcutta High Court had earlier rejected her claim, citing discrepancies between the statements of the Qazi and her father. The Supreme Court, however, overturned that decision.

The bench emphasised that all laws must be interpreted in line with the constitutional values of equality, dignity and personal liberty. The court directed Roshan Ara’s former husband to deposit ₹7 lakh along with the value of 30 grams of gold directly into her bank account. In case of delay, the court ordered a 9% annual interest and required an affidavit confirming compliance.

The judgment stressed that while interpreting laws, courts must consider social realities and women’s lived experiences so that legal protections are not reduced to mere words but ensure real, practical safeguards.
